Executive Diploma in Competition Law and Consumer Contracts


Objective

The new Competition Ordinance (Cap. 619) brings in fundamental changes to businesses. In this regard, proper dealing with consumers, as always, is a major part of business operation in Hong Kong. In conducting trading and operation, businesses are with daily interfaces with laws and regulations, which are getting complicated and keep evulving.

This Executive Diploma aims at highlighting key areas of risks in business operations with a view to helping structuring their trade logistics for better business outcomes. Though case studies and legislation review, in relation to dealing with consumers under the legal regime of the Competition Ordinance (Cap. 619), managers, business executives and business owners may prepare properly to avoid such legal aspects to avoid traps and to safeguard their personal and corporate interests.

Topics covered are all crucial to them, which include Consumer Law Basics and Dispute Resulution, Competition Law Fundamentals and Conduct Rules, Merger Rules, Block exemptions and Enforcement.

The Programme also covers the key case laws and main means of alternative dispute resulution in relation to contractual disputes in such transactions, with reference to local and overseas experience.

Consumer Law Basics and Dispute Resulution (9 hours)

  • Consumer contract essentials
  • Product liability and service liability
  • Exemption clauses, limitation clauses and unfair contract terms
  • Consumer guarantees, warranties and implied terms
  • Consumer dispute resulution, enforcement and remedies

Competition Law Fundamentals (18 hours)

  • Overview of Hong Kong Competition Ordinance (Cap 619)
  • Vertical agreements and horizontal agreements
  • Meaning of "Demand and Supply" and Economies of Scales
  • Market dominance or market power
  • Monopulistic operation and uligopulistic operation
  • Perfect competition and imperfect market

Conduct Rules, Merger Rules, Block Exemptions and Enforcement (18 hours)

  • 1st conduct rule in operation
  • 2nd conduct rule in operation
  • Merger rule in operation
  • Block exemptions in practice
  • Enforcement and remedies
  • Case study and case laws in the UK and the EU

Award

Executive Diploma in Competition Law and Consumer Contracts will be awarded to those who have met all requirements.

Satisfactory Completion of the Programme

The minimum required attendance rate is 70%. No assessment is required for the Programme.

Lecturer

The lecturers are practicing barrister or barrister-at-law. It ensures up-to-dated case laws would be shared to participants.
